Terms: Buyer’s premium of 13% flat fee will be added to the final bid price. NO PERSONAL CHECKS or CASH ACCEPTED. Business checks may apply for exemption, yet not guaranteed acceptance. You may pay via PayPal as a merchant service with an additional surcharge assessed. The option for PayPal will be found when you click your “invoice” tab in your profile online or when you receive your email invoice.  Sales tax applies where applicable. If you need additional services such as shipping, transportation, package and handling or other costs… they will be added to your standard invoice via email and always found within your profile on our site.  You can use your Visa, Master Card, Discover or Diners Club. All items are purchased AS-IS WHERE-IS. Please contact info@irsauctioneer.com for any questions prior to bidding or the contact information given for the project manager for that auction. After the auction is over you will receive an invoice via your registered email with the applicable Buyers Premium added, any applicable “additional” cost and applicable sale tax. If you do not receive an invoice by 6:00am of the next day, please contact the project manager of the auction and notify them. The project manager contact info is on the front page of the auction. 

All payments must be made prior to pick-up even if alternate arrangements are agreed upon.  IF PAYMENT IS NOT MADE PRIOR TO THE POSTED PICKUP DAY/TIME ALL ITEMS ARE CONSIDERED ABANDONED AND YOUR BID NUMBER WILL BE SUSPENDED/DECLINED AND YOU MAY NOT REGISTER AGAIN.   TO BE REINSTATED THE FULL INVOICE AMOUNT MUST BE PAID AND ON THE FIRST OFFENSE A $25 REINSTATEMENT FEE WILL BE CHARGED.  IF SUSPENDED YOU WILL NOT BE WELCOME TO BID ON OTHER AUCTIONS.  IF YOU ARE BIDDING ON OTHER AUCTIONS THE BIDS WILL BE DELETED.

 

BUYERS ARE RESPONSIBLE FOR ALL SHIPPING COSTS, ARRANGEMENTS AND ARE RESPONSIBLE TO KNOW THE SHIPPING COST OF THE ITEM(S) TO PURCHASE PRIOR TO WINNING THE ITEM AT AUCTION SO AS TO KNOW THE TOTAL DUE. THE BUYER MUST MAKE ALL NECESSARY SHIPPING ARRANGEMENTS WITH THE SHIPPER AND PAY THE SHIPPER DIRECT. THE ITEMS MUST BE PAID IN FULL BY THE SCHEDULED TIME AND DATE OF PICK UP AND PRIOR TO THE SHIPPER RETRIEVING THE ITEM(S).

 

Waiver of Liability. Auctioneer shall not be liable for, and Buyer assumes all risk of, any injury, damage or illness incurred by any person, property or vehicle, during or in any way arising out of entry into or upon the seller's premises for any reason including inspection of item(s) and pick up of item(s) purchased, including but not limited to claims for personal injury, property damage, medical expenses, and loss of services.

NO refunds, chargebacks or guarantees are offered. PLEASE REVIEW ALL ITEMS AND KNOW THE ITEMS YOU MAY WIN. Unless other arrangements have been made, after the scheduled pickup date and time, items will be considered abandoned. Bring labor for pick-up as well as boxes/containers and packaging if necessary.

 

Increasing your own bid/Bidding Errors

Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. Our software will allow you to increase your own bid due to this bidder/buyer strategy. Therefore, you should immediately review your bids once submitted. If you mistakenly increase your own bid, place your bidder number in the bid field, or make a typo you must immediately contact the project manager and notify them of the issue. We will not reverse bids after the auction has closed no exceptions.

 

Staggered Closing:

The online auction closes (number of items per minute is included in the auction DETAILS) item(s) every minute. This feature will close the bidding on intervals. This feature works great with the auto-extend feature to closely emulate a 'live' auction. If an item receives a bid within 5 minutes of ending the item will be extended 5 additional minutes, unless otherwise disclosed in individual auction terms.

 

Dynamic Closing.

The closing time of an asset is automatically extended an additional 5 minutes whenever a bid is placed within the last 5 minutes of the asset's closing time. Otherwise the closing happens just as the start with each item closing at the same interval of separation as when they started.

 

Bid Notification:

If you have been outbid you will be notified by email….  On the day of the auction ending the amount of bids may prevent timely notifications… therefore it is incumbent upon all buyers to be aware of the bidding and winning status of all auctions and not merely rely on the systems auto notification process.

 

Winning Bidder Notification:

You will be contacted by email ONLY (you are responsible for checking your email) If you feel you have won an item and have not received an email you must notify us by email or call the contact number given (IRSA admin office 614 877-7320 or info@irsauctioneer.com) immediately.  Once an invoice has been sent out after the closing of an auction, any bidder can access their invoice at any time once logged in to our platform.  Go to the top header and click on “Account”.  From here your individual profile information will appear.  Under the word “ACCOUNT” there are tabs and one tab is “invoice”.  Click this tab and see all invoices from any auction where you were the winning bidder.  Click on any individual invoice and a digital copy of the invoice appears and the option to pay the invoice is revealed as well.

 

In the event an item is not available for pickup or is missing, the buyer must, notify our on-site staff. The project manager of the auction will make the necessary adjustments prior to you leaving the pickup location. After 24 hours of the actual pickup ending time, the Auctioneer and buyer agrees that no adjustment or refund(s) will be made.

 

CAUTION:

Various items may be joined, do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions. YOU ARE PURCHASING THE DESCRIBED ITEM(S).

 

Catalog Inaccuracies:

You are bidding on the described item, unless otherwise described, not the photo. Possibly the wrong photo is displayed, always read the item description and call or email with any questions. BUT ALWAYS KNOW WHAT YOU ARE BIDDING ON BEFORE BIDDING!

 

WARRANTY & CONDITION OF ITEMS SOLD:

All items are sold "AS IS, WHERE IS”, with NO WARRANTY expressed or implied by the lot number affixed to the item, without any implied or expressed warranty. Descriptions are believed to be accurate but not guaranteed. If you are not certain of the condition or use of an item, please bid accordingly. You are bidding on the described item not the photo and previews are encouraged.

 

Bidders are responsible for their own removal/pickup. Any item NOT picked up by the set time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid receipt. Please ensure that movers or anyone picking up items on your behalf have your paid receipt(s) at the pickup location. No items will be released without a paid receipt.

 

IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items.

The auctioneer reserves the right to add or remove items from the auction. Split or combined lots. Add minimum bids or reserve prices. Cancel, suspend, extend or reschedule an individual item and or auction event. Make changes to the auction closing times or inspection or removal times

 

Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Franklin County Ohio. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

 

LIMITATIONS:

Individual auctions will have applicable terms and conditions that apply to that auction. All individual terms and conditions supersede “General” terms and conditions. Therefore, all general terms and conditions apply unless the “individual” terms and condition conflict, in which case the individual terms and conditions apply. Final terms and conditions cannot be altered except in writing by the Auctioneer.

 

We have a new Option to purchase this year with our IRSauctioneer STORE. This is a buy-it-now or single price option and yet works the same in that we will send emails on a scheduled basis each evening and expect payment same night. Then arrangements can be made to retrieve the item(s).
